General terms and conditions of sale
These General Terms and Conditions of Sale (hereinafter the “GTCS”) govern sales made on the website www.capulette.com (hereinafter the “Website”).
The Website is published by CAPULETTE. Legal information about the company is available on the Legal Notices page of the Website.
Any order placed on the Site constitutes full and unconditional acceptance of these Terms and Conditions.
ARTICLE 1 — PRODUCTS
The products offered for sale are described as accurately as possible, particularly with regard to their features, materials, colors, and sizes.
Products are available while supplies last.
If a product is unavailable after an order has been confirmed, Capulette will notify the Customer as soon as possible and issue a refund for the product in question.
ARTICLE 2 — PRICE
Prices are listed in euros, including all taxes.
Shipping costs are displayed to the Customer before the order is confirmed. All shipping rates and terms are available in the “Shipping” tab on the Website.
Capulette reserves the right to change its prices at any time. The applicable price is the one displayed at the time the order is confirmed.
ARTICLE 3 — ORDER
The Customer selects the products they wish to purchase and confirms their order after reviewing its contents and delivery information.
The order is officially placed once payment has been confirmed.
A confirmation email is sent to the Customer at the email address provided when placing the order.
Capulette reserves the right to refuse or cancel an order in the event of suspected fraud, an obvious error, or a dispute regarding a previous order.
ARTICLE 4 — PAYMENT
Payment is made at the time of order using the payment methods offered on the Site.
Transactions are secured by the payment service providers used by Capulette.
Capulette does not store the Customer's banking information.
ARTICLE 5 — DELIVERY
Orders are delivered to the address provided by the Customer at the time of ordering, according to the shipping methods offered on the Website.
Delivery times and fees are provided to the Customer before the order is confirmed.
Delivery times may vary depending on the destination and the carrier you choose.
If there is a problem with a delivery, the Customer may contact Capulette at hello@capulette.com.
The Customer is asked to check the condition of the package and the products upon receipt and to report any issues to Capulette as soon as possible.
ARTICLE 6 — RIGHT OF WITHDRAWAL
In accordance with applicable legal provisions, the Customer has 14 days from the date of receipt of the order to exercise the right of withdrawal, without having to provide a reason for the decision.
The Customer must return the products in their original condition, unworn, and, to the extent possible, accompanied by their original packaging and accessories.
The Customer is responsible for any depreciation in the product's value resulting from handling that is not necessary to verify its nature, characteristics, and proper functioning.
The right of withdrawal does not apply to products that are personalized or made to the Customer’s specifications.

ARTICLE 8 — REFUNDS
Under the right of withdrawal, orders placed online, including sale or discounted items, are eligible for a refund.
The refund will be issued within a maximum of 14 days from the date of receipt of the notice of withdrawal. Capulette may delay the refund until it receives the items or proof that they have been shipped.
Refunds are issued via the same payment method used when placing the order, unless otherwise agreed by the Customer.
Purchases made in-store are non-refundable. An exchange or store credit may be offered.
Products that are customized or made to the Customer’s specifications are not eligible for the right of withdrawal. They are neither refundable nor exchangeable and cannot be credited.
ARTICLE 9 — STATUTORY WARRANTIES
Products sold by Capulette are covered by the applicable legal warranties, including the legal warranty of conformity and the legal warranty against hidden defects.
These warranties apply regardless of any commercial warranties that Capulette may offer.

ARTICLE 10 — INTELLECTUAL PROPERTY

ARTICLE 12 — GOVERNING LAW AND DISPUTES
These Terms and Conditions are governed by French law.
In the event of a dispute, the consumer-customer may bring the matter before the competent courts in accordance with the rules of general law.
